Summary

Amends the Arizona Constitution to bar the state, counties, cities, towns and other political subdivisions from imposing any tax or fee based on how many miles a person drives. It also bars them from monitoring or limiting a person's vehicle miles without that person's voluntary consent. Interstate commercial vehicles that report under interstate fuel-tax or registration agreements are exempt, as are vehicles owned and operated by government. The state currently does not have a law taxing mileage.

Analysis

ANALYSIS BY LEGISLATIVE COUNCIL Proposition 141 would amend the Arizona Constitution to prohibit this state and any county, city, town, municipal corporation or other political subdivision of this state from: 1. Imposing a tax or fee based on the number of miles a person travels in a motor vehicle. 2. Monitoring or limiting the number of miles a person travels in a motor vehicle, unless the person voluntarily consents. Proposition 141 would not apply to the following: 1. The miles traveled by a person in a motor vehicle if the motor vehicle is a commercial vehicle that operates in more than one state and an interstate agreement is established for reporting fuel taxes or registration fees. 2. The miles traveled by a person in a motor vehicle if the motor vehicle is owned and operated by this state or a county, city, town, municipal corporation or other political subdivision of this state.
